Today, the matter appears under the heading "To Be Mentioned" at the instance of the Court after discovering the order passed by a co-ordinate Bench dated April 16, 2021 under which this writ petition was disposed of.

Today, Mr. Amal Kumar Sen, learned Additional Government Pleader appearing for respondent nos. 1 to 3 prays for leave to file a short affidavit in opposition disclosing the fact that an appeal was carried out subsequently from the said order dated April 16, 2021, the Hon'ble Division Bench by its order dated August 17, 2023 which is disclosed through this affidavit in opposition had set aside the said order dated April 16, 2021 in so far as this writ petition is concerned and

accordingly, this writ petition is required to be adjudicated upon.

The affidavit in opposition filed today in Court, affirmed on September 8, 2023, is taken on record. In view of the above, there is no modification required in the order dated March 4, 2024 and the direction made therein stands.
