The learned Counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated. It is further submitted that the first information report relates with the incident that had happened almost ten years back. It is further submitted that the other co-accused have been granted bail by coordinate Benches.

The learned Counsel for the State, in opposing the prayer for anticipatory bail, has drawn our attention to the statement of the victim recorded under Section 164 Cr.P.C. It is further submitted that the charge sheet has already been filed.

Considering the gravity of the offence and the involvement of the petitioners therein and more particularly, that the petitioners have been named by the

victim in her statement recorded under Section 164 of the Code of Criminal Procedure and the fact that the other co-accused persons are not similarly placed as that of the present petitioners and also having regard to the fact that Gita Mashi was in custody and has been recently granted bail, we are not inclined to grant anticipatory bail to the present petitioners. 4.

Accordingly, the prayer for anticipatory bail of the petitioners is rejected. 5.

CRM (A) 1915 of 2024 is, thus, dismissed.
