Mr. Sabyasachi Bhattacharjee, learned counsel appearing for the petitioner referring to the F.I.R., Annexure P-1 at page 25 to the writ petition submits that, save and except registering the F.I.R. the police had not taken any further steps against the accused. The disputes arose out of family rivalry and/or unauthorized encroachment of the premises of the petitioner.

Mr. Swapan Banerjee, learned State counsel appearing for the State respondents submits a police report dated June 6, 2024 issued under the seal and signature of the Officer-in-charge Balagarh Police Station, the same is taken on record.

The police report shows that, the investigation is going on. The police had registered a criminal case

bearing Balagarh P.S. case No. 250 of 2024 dated May 26, 2024 under the several provisions of the Indian Penal Code. In so far as the F.I.R. lodged by the petitioner is concerned the police had registered the F.I.R. No. 244 of 2024 dated May 23, 2024. After considering the submissions made on behalf of the parties and upon perusal of the materials on record it appears that, the police authority has been acting diligently.

However, the police authority shall take all further steps strictly in accordance with law as expeditiously as possible.

Since affidavits are not called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents.

With the above directions, this writ petition being WPA 15203 of 2024 stands disposed of, without any order as to costs.
