Allowed CRM (A) 1919 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 03.06.2024 in connection with Noapara Police Station Case No.74 dated 15.05.2024 under Sections 135/138 of the Electricity Act, 2003.

In the matter of : Sunil Yadav ... Petitioner Mr. Bidyut Kumar Halder, Mr. Indranil Halder ...for the Petitioner Mr. Subrato Roy, Mr. Rahul Ganguly .....for the State Ms. Sreyashee Biswas ......for CESC Limited Having regard to the nature of allegations as apparent form the case records, we are inclined to grant anticipatory bail to the petitioner subject to the following conditions:- The petitioner shall deposit 50 per cent of the finally assessed amount of Rs.4,28,690/- within a period of ten days from date before the relevant authorities of Calcutta Electric Supply Corporation Limited.

Upon such deposit, in the event of arrest, the petitioner shall be released on bail on furnishing a bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of like amount each, to the satisfaction of the Investigating Officer. The

petitioner shall meet the Investigating Officer as and when called for.

The petitioner shall comply with the conditions as stipulated in Section 438(2) of the Code of Criminal Procedure.

CRM (A) 1919 of 2024 is, accordingly, allowed. Criminal Section is directed to supply certified copy of this order, if applied for, upon compliance of necessary formalities.
