AND In the matter of:- Jawhar Hazra ... petitioner Mrs. Karabi Roy ....for the petitioner I find that learned sessions court was pleased to direct the petitioner to pay monthly maintenance of Rs.600/- by way of maintenance.

Mrs. Roy, learned advocate appearing for the petitioner submits that a civil suit was filed by the present petitioner for declaration of nullity regarding the marriage. However, the same has been dismissed and appeal is pending.

Learned advocate further submits that the petitioner is presently aged about 80 years and is suffering from various ailments.

Having regard to the fact that there is no change of circumstances before this Court in the revisional application and the earlier order dated 07.06.2013 reflects that the petitioner was directed to continue payment of the maintenance on each and

every month. I am of the view that at this belated stage no interference is called for.

Accordingly, C.R.R.1480 of 2013 is disposed of. Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

The opposite party will be at liberty to recover the arrears by way of an appropriate application before learned Judicial Magistrate.
