In Re: An Application under Section 401 read with Section 482 of the Code of Criminal Procedure.

The present revisional application was preferred against the order dated 27.12.2012 passed by the learned Judicial Magistrate, 2nd Court, Malda in connection with Case No. 771 (M) of 2009 (corresponding to T.R. No. 2722 of 2009) under Section 125 of the Code of Criminal Procedure. By the said judgment and order, the learned Magistrate was pleased to award Rs.3,000/- per month to the wife and Rs.2,000/- per month to the minor son for maintenance and to give effect to the said order from 27.12.2012 itself.

I have taken into account the reasons assigned by the learned Magistrate while arriving at the conclusion and I do not find any reason to interfere with the same. The opposite party no.2/wife will be at liberty to recover the arrears by taking out appropriate application before the learned Magistrate.

Accordingly, CRR 1481 of 2013 is dismissed.

Interim order, if any, is hereby vacated.

All pending applications, if any, are consequently disposed of.
