Petitioner is aggrieved by the manner in which Katwa Police Station Case No.37 of 2024 has been progressing so far as the investigation is concerned.

Today, a report has been submitted. Report reflects that the same status as earlier on 01.07.2025 when notices were issued to the treasury and ascertainment of the authenticity of the gift deed. Having considered the manner in which the investigation is progressing, I direct the SDPO/Additional SP/in-Charge of Katwa Police Station to monitor the case each and every week and submit progress report on each and every 30 days before the learned ACJM, Katwa. In case the learned ACJM, Katwa after a period of three months is not

satisfied with the progress of the investigation, the learned ACJM, Katwa would in that case direct the SDPO to again change the investigating officer of the case. The SDPO/Additional SP, Katwa would be monitoring the case who would ensure that the purpose for which the delay has been caused is subserved by obtaining the report from the concerned authorities particularly treasury and the ADSR, Calcutta-I. It would not be out of place to state that more than 18 months have passed since the investigation commenced and although there has been a change of the investigating officer but a document based investigation which is being carried out requires much persuasion to arrive at a logical conclusion. The concerned superior officer would monitor to the extent, so that within a reasonable period of time the investigation is taken to its logical conclusion.

With the aforesaid observations, WPA 14047 of 2025 is disposed of.

Report so submitted be kept with the record.

The investigating officer of the case is personally present in Court today. His further appearance before this Court is dispensed with.
