Allowed CRM (A) 1920 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 03.06.2024 in connection with Contai Police Station Case No.171 of 2024 dated 12.03.2024 under Sections 135(1)(a) and (b) of the Electricity Act, 2003.

In the matter of : Durgapada Maity ... Petitioner Mrs. Pampa Dey Dhabal, Mr. Krishna Deo Das ...for the Petitioner Ms. Trina Mitra .....for the State Ms. Sreyashee Biswas ......for WBSEDCL Having regard to the nature of allegations as apparent form the case records, we are inclined to grant anticipatory bail to the petitioner subject to the following conditions:- The petitioner shall deposit 50 per cent of the finally assessed amount of Rs.1,54,223/- within a period of ten days from date before the relevant authorities of West Bengal State Electricity Distribution Company Limited. After deposit of such amount, in the event of arrest, the petitioner shall be released on bail on furnishing a bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of like amount each, to the satisfaction of the Investigating Officer.

The petitioner shall meet the Investigating Officer as and when called for.

The petitioner shall comply with the conditions as stipulated in Section 438(2) of the Code of Criminal Procedure.

CRM (A) 1920 of 2024 is, accordingly, allowed. Criminal Section is directed to supply certified copy of this order, if applied for, upon compliance of necessary formalities.
