Each of the revisional applications involves execution case.
CRR 2187 of 2023 relates to Misc. Execution Case No.30 of 2020, CRR 2188 of 2023 relates to Misc. Execution Case No.3 of 2022, CRR 2189 of 2023 relates to Misc. Execution Case No.44 of 2022, CRR 2190 of 2023 relates to Misc. Execution Case No.27 of 2022 and CRR 2191 of 2023 relates to Misc. Execution Case No.26 of 2021.
As the subject matter involved is common, by a single order, five revisional applications are disposed of. Mr. Aniket Mitra, learned advocate appearing for the petitioner submits that the total dues in the aforesaid five execution cases are Rs.1,74,000/- till date. It is alleged that
the husband is trying to pay a fraction of the monthly maintenance and trying to evade the process of law thereby creating hardship upon the present petitioner/wife. Learned advocate for the petitioner also submits that the husband is having sufficient means and he is designedly trying to make things complex so that the wife faces harassment.
It has been submitted that the current quantum of maintenance which is being paid in Misc. Case No.55 of 2012 is Rs.10,000/- per month.
It is henceforth directed that the learned family court will apart from the sum of Rs.10,000/- which is to be paid regularly in the mode and manner directed by the court for regular maintenance would enforce that the husband pays a sum of Rs.15,000/- per month towards the arrears till the arrears in the aforesaid five misc. execution cases are liquidated. Substantial time has been granted to the husband to clear the dues in the execution cases. No further leniency should be shown by the family court. Learned trial court will see that further unnecessary hardship is not created to the petitioner/wife. With the aforesaid observations, CRR 2187 of 2023, CRR 2188 of 2023, CRR 2189 of 2023, CRR 2190 of 2023 and CRR 2191 of 2023 are disposed of.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of such requisite formalities.
