For the State Report submitted by the State is taken on record. The petitioner alleges that the local Panchayat being Deypara Gram Panchayat has encroached upon a portion of the petitioner's property and constructed road therein taking advantage of the petitioner's absence therefrom.

The petitioner seeks to submit a representation before the Block Development Officer, Krishnangar, being the 5th respondent herein, ventilating his grievance.

It appears from the report submitted by the State that the State called for a report from the Gram Panchayat and was informed that the previous owner of the land granted verbal consent to the local people to construct the alleged road through his land for uplifting rural life and improving the school education during 1960-1984. The road has been constructed by collecting subscription from every corner and is used by more than 5000 people for their egress and ingress. Be that as it may, since the petitioner seeks to submit a representation before the concerned authority

seeking restoration of his property, he is at liberty to submit such representation before the 5th respondent within 7 days from date.

The 5th respondent shall consider and dispose of the representation within four weeks of receipt of the same upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
