( Via Video Conference ) Mr. Sanjib Seth, Mr. Saptarshi Basu ... for the petitioner This is an application for expeditious hearing. Record reveals that the hearing of the petition dated April 25, 2017 was fixed on December 18, 2019 and the petition was heard and the next date was fixed on March 23,2020 for further hearing. The hearing of the said application was adjourned thereafter on several occasions and the next date is fixed on December 2,2021.

Learned advocate for the petitioner submits that an application for vacating the ex parte hearing of the suit as well as show cause petition filed in connection thereto are still pending.

In view of the order sought and proposed to be passed there is no necessity of issuing any notice upon the opposite parties . However, the petitioner shall be obliged to forward a copy of this application as well as this order upon the opposite parties or their learned advocates in the Court below forthwith.

CO 1661 of 2021 is disposed of by requesting the learned Civil Judge (Senior Division ), 2nd Court at Barasat to take up the hearing of the petition dated April 25, 2017 filed in connection with Title Suit No. 236 of 2014 on the next date fixed and to dispose of the same as expeditiously as possible and preferably within a period of eight weeks from the next date fixed without granting any unnecessary adjournment to

either of the parties.

Learned Trial Judge is further requested to make endeavour to dispose of the aforesaid pending applications as expeditiously as possible.

Urgent photostat certified copy of this order, if applied for, be given to the learned advocate for the parties on usual undertakings.
