The parties to the instant application under Article 227 of the Constitution of India are the husband and wife, they have a minor son, namely Soumalya Dey who is in the custody of his father, the opposite party herein. The petitioner, for the custody of the son, has initiated a proceeding under Section 25 of the Guardian and Wards Act, 1890 which is pending before the learned Additional District Judge, FTC-II, Howrah being Misc. Case No.188 of 2021.

The opposite party since has removed the child from his earlier school and has admitted him in a new school, the petitioner by an application had prayed for readmission of the son in his earlier school. The petitioner though has challenged the Order No.38 dated May 02, 2024 passed in the said Misc. Case dismissing her application for re-admission of the son in the earlier school but has agreed for the disposal of the instant application on the following terms agreed by and between the parties; the petitioner since is a teacher for the purpose of looking after the education of the son shall meet him at her matrimonial home at Arupara, near Ramkrishna Mandir, P.O. G.I.P. Colony, P.S. Jagacha,

District: Howrah, PIN - 711112, on every Saturday and Sunday for two hours from 11:30 a.m. to 1:30 p.m. The opposite party shall facilitate such meeting of mother and son without any disturbance.

With the above CO 2033 of 2024 is disposed of without any order as to costs.
