Mr. Dilip Kumar Maiti ... ... for the Petitioner Mr. Supratim Dhar Mr. Sanjay Mukherjee ... ... for the State Learned counsel appearing for the petitioner submits that the petitioner has preferred an application before the Sub-Inspection of Schools, Tehatta New Circle, Palishipara, Nadia, West Bengal, for consideration of full pension on the basis of the revision of pension for Pre 01.01.2016 retires, in terms of the Memorandum No.525F(Pen) N/F.1P-155/2022 dated Kolkata, the 19th July, 2022 read with memorandum no.535-F(Pen) dated the 1st October, 2019. However, the said application dated 05.05.2025 has not been considered by the SI of Schools being the respondent no.5 in the instant application.
The respondent no.5, upon issuing a prior hearing notice of at least 7 days to the petitioner and after granting her an opportunity of hearing shall dispose of the representation seeking full pension on the basis of the aforesaid memoranda, strictly in accordance with law. All the procedures laid down under the relevant rules shall be followed
strictly for considering the representation. The entire exercise shall be carried out and completed by the respondent no.5 and/or any other relevant State authorities within a period of eight weeks from date of communication of this order and the reasoned order shall be communicated to the petitioner within a period of two weeks from the date of reasoned order to be passed.
It is made clear that, this Court has not gone into the merits of the claim of the petitioner and the petitioner shall be at liberty to urge all points he wishes to raise, by relying upon such records and documents as he may choose to place before the respondent no.2.
The Writ petition being WPA 14112 of 2025 is accordingly disposed of.
There will be no order as to costs.
Since no affidavit has been invited, the allegations made in the writ petition are deemed to have been denied.
