The revisional application has been preferred challenging an order dated 25.09.2024 passed by the learned Additional Chief Judicial Magistrate, Jangipur, Murshidabad in connection with G.R.

Case No.

2192/2024, arising out of Sagardighi Police Station Case No. 280 of 2024 dated 03.07.2024 under Sections 329(4)/118(1)/118(2)/109/3(5) Bharatiya Nyaya Sanhita of 2023, issuing warrant of arrest against the present petitioner.

It is submitted by the petitioner that as he is employed outside the State, he had no knowledge about the summons issued by the Court and due to such ignorance warrant of arrest has been issued.

The petitioner intends to surrender before the Trial Court and pray for regular bail but as he has no other order protecting him from arrest, he has prayed for stay of warrant of arrest issued vide the order dated 25.09.2024 for a limited period.

Considering the said facts and circumstances, the warrant of arrest issued vide dated 25.09.2024 be stayed

for a period of 10 days, on the condition that the petitioner during the said period, shall surrender before the trial Court and pray for regular bail, which the learned Magistrate shall consider in accordance with law. 5.

In case the direction to surrender is not complied with by the petitioner herein, the order of stay shall stand vacate automatically.

It is made clear that this Court has not gone into the merits of the case against the accused person. 7.

CRR 2721 of 2025 stands disposed of.

Applications, if any, connected thereto stand disposed of consequently.

9.

Interim order, if any, stands vacated.

10.

Photostat certified copy of this order, if applied for, being given to the parties on priority basis upon compliance of all formalities.
