Petitioners are directed to serve a copy of the revisional application upon Mr. Bhattacharya, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities. Learned advocate for the petitioners submits that they have been falsely implicated in connection with the instant case and the present case under Sections 498A/406/506/34 of the Indian Penal Code read with 3/4 of the Dowry Prohibition Act has been registered pursuant to the proceedings under Section 12 of PWDV Act initiated at the instance of the petitioner no.3, who happens to be motherin-law. Learned advocate also submits that the provisions for registration of the case has been initiated for wreaking vengeance and the same is with ulterior motive. Be that as it may, the investigating of the case is continuing.

In view of the contentions advanced and the submission relating to the present case which was initiated pursuant to the proceedings under the provisions of PWDV Act, I direct the petitioners to bring the same to the notice of the Investigating Officer as well as the Superintendent of Police of the concerned District so that unnecessarily the petitioners may not be harassed in course of investigation of the proceedings.

With the aforesaid observations, CRR 2192 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of such requisite formalities.
