Bhattacharya ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division), 1st Court at Barasat to dispose of Title Suit No. 516 of 2021 expeditiously.
Mr. Bhattacharya, learned advocate appearing for the petitioner submits that the suit was filed sometime in the year 2021 and the hearing of the suit is being adjourned from time to time on the prayer of the defendant/opposite-party. He further submits that the suit was fixed for ex parte hearing on two occasions and such orders were subsequently recalled.
In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned
advocate representing the opposite party before the learned trial judge forthwith.
After going through the order-sheets appended to this civil revision application this Court finds that July 6, 2026 has been fixed for further evidence of PW-1 and for filing the amended written statement in the meantime.
In the light of the submission made by Mr.
Bhattacharya, learned advocate appearing for the petitioner, CO 2057 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Division), 1st Court at Barasat to make an endeavour to dispose of Title Suit No. 516 of 2021 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
