Petitioner is aggrieved by the fact that she is unable to attend the Court because of certain obstruction being created on the date so fixed before the learned Judicial Magistrate, 4th Court, Katwa in connection with GR Case No. 872/2020.
Learned Advocate appearing for the petitioner submits that the accused is influential and is closely associated to the local people's representative and as such is creating hindrance to the present petitioner for smoothly participating in the process of trial. The prayer which has been advanced on behalf of the petitioner before this Court is transfer of the proceedings. Mr.
Chottopadhyay, learned Advocate appearing for the Opposite Party No.2 and Mr. Sur, learned Advocate appearing for the State opposes the prayer advanced on behalf of the petitioner and the grounds assigned for transfer.
However, having regard to the anxiety so expressed by the petitioner, I am of the view that the petitioner would prefer an application addressing to the Inspector-in-charge of Katwa Police Station 48 hours before the date is fixed before the learned Trial Court. The Inspector-in-charge will depute an officer of his choice for accompanying the petitioner to the Court premises. If there are any hindrance created to the petitioner from attending the Court in that case it would be the discretion of the Inspector-in-charge to increase the number of police personnel.
As most of the witnesses are from Katwa and the investigation has been conducted by Katwa Police Station at this stage, I am not inclined to transfer the case, as directed above. The police authorities would adhere and abide by the direction made above, Mr. Sur will communicate the order to the Inspector-incharge of Katwa Police Station. With the aforesaid observations CRR 1876 of 2021 is disposed of.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
