The petitioners are aggrieved by the fact that the private respondent has constructed a boundary wall with tin shed that obstructs the ingress and egress to his shop room. It is submitted that the boundary wall is on public space.

The petitioners have addressed a representation to the Block Development Officer, Pandua, Hooghly complaining of the above acts and omissions by the respondents.

In that view of the matter, the Block Development Officer, Pandua, Hooghly shall forthwith look into the petitioners' representation and pass suitable order after giving due opportunity to all concerned parties including the private respondent. A reasoned order may be passed.

It is expected that the aforesaid process shall be completed by the Block Development Officer, Pandua, Hooghly within a period of one month from date mandatorily and positively.

The report of the Officer-in-charge, Pandua Police Station dated 27th September, 2021 filed in Court today be taken on record.

Since no affidavits have been called by this Court, the allegations contained in this writ petition against the respondents shall not be deemed to have been admitted by them.

In view of the above, the instant writ petition shall stand disposed of.

There will be no order as to costs.
