This is an application for recalling of an order dated 6th February, 2020 passed by this Court in CO No. 1883 of 2017 upon an application under Section 24 of the Code of Civil Procedure allowing the prayer of the petitioner for transferring matrimonial suit being MAT Suit No. 62 of 2017 from the 4th Court of Additional District Judge at Barasat to the Court of Additional District Judge at Serampore.

The said revisional application was disposed of directing the opposite party to pay conveyance charges at the rate of Rs. 400/- per day to the petitioner for her transportation from Serampore to Barasat on the date of trial of the suit.

In the instant application the petitioner has renewed her prayer for transferring the case to a Court of competent jurisdiction at Serampore.

Learned advocate for the respondent /opposite party has filed an information slip showing that the said Mat Suit No. 62 of 2017 was disposed of on 13th January, 2021 by passing a decree of divorce against the petitioner. In view of such circumstances, since the matrimonial suit has already been disposed of the instant application become infructuous .

Hence application being CAN 2 of 2020 is rejected.
