The revisional application arises out of an order of rejection of an application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure passed in Title Suit No.196 of 2015, by the learned Civil Judge (Senior Division), 5th Court at Alipore. The order impugned is an appealable order. The revisional application is dismissed.

The petitioner is at liberty to take back the certified copy of the order impugned, upon furnishing a photocopy thereof. There shall be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
