The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The plaintiff no.1 in a suit for partition being Title Suit No. 261 of 2015 pending before the learned Civil Judge, (Senior Division), Baruipur, District : 24-Parganas (South) is the petitioner of the instant revisional application under Article 227 of the Constitution of India, he is complaining delay in disposal of the application for injunction filed in the said suit. It appears from record that the said application was filed on July 08, 2015. An application for injunction by its nature demands expeditious disposal.

The learned Trial judge is therefore requested to dispose of the said application as expeditiously as possible, preferably within a period of six weeks from the date of communication of this order.

C.O. 2036 of 2024 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
