The records of the case reflect that initially there was a direction on 22.02.2019 for service upon the private respondents. Thereafter, on 08.03.2019 and 05.04.2019 the case was adjourned as service was not complete.

The subject-matter of the case relates to an order dated 22.12.2017 passed by the learned Additional Sessions Judge, Chanchal Malda in connection with Harishchandrapur Police Station Case No. 959 of 2017 wherein bail was granted pursuant to the order of anticipatory bail having been allowed. I have taken into account the time period which has passed in the meantime and, I am of the view that, until and unless there are changed circumstances, it would not be fit and proper to interfere at this belated stage.

Having regard to the same, I grant liberty to the petitioner to approach the jurisdictional court, if till date the proceedings are pending before the Special Court/jurisdictional

court. The learned Special Court/jurisdictional court, if it feels that its discretion is warranted in the facts and circumstances of the case for interfering in respect of the bail granted, it would be at liberty to exercise the same after issuing notice and providing audience to the affected parties.

At this stage, no interference is called for. With the aforesaid observations, CRM 5382 of 2018 is disposed of.
