Mr. Ganguly, learned Senior Advocate appearing for the petitioner submits that his client did not play an active and predominant role in the affairs of M/s. Burdwan Sunnmarg Group which is alleged to have misappropriated funds of the depositors. He was an office bearer of one of the organisations for a brief period of time.

Dastoor, learned Additional Solicitor General submits petitioner in spite of his retirement continued to play an active role in the affairs of the aforesaid group. Petitioner was involved in similar activities through another group of companies in 2012. Further investigation is in progress. In view of the fact further investigation is in progress and the contours of the crime have not clearly emerged as yet, Mr.

Ganguly seeks to withdraw the application and file afresh upon conclusion of further investigation.
