This application under Article 227 of the Constitution of India is at the instance of the respondent in the title Appeal No. 113 of 2012 praying for a direction upon the learned Additional District Judge at Howrah to dispose of the Title Appeal expeditiously.

Learned Advocate for the petitioner submits that the appeal is pending from the year and the applicant/petitioner herein is trying to delay the hearing of the appeal by praying for an adjournment on frivolous grounds. In view of the order sought and proposed to be passed, there is no necessity to serve a notice upon the opposite party. However, learned Advocate on record for the petitioner shall be obliged to forward a copy of this application along with this order to the opposite parties/learned Advocate representing the opposite parties before the learned Judge of the First Appellate Court.

From the order sheets appended to this application, this Court finds that 18th April, 2025 was fixed for hearing of the appeal. Learned Advocate for the petitioner submits that the next date of hearing of the appeal is on November 13, 2025.

In the light of the submissions of learned Advocate for the petitioner, CO No. 2266 of 2025 is disposed of by requesting the learned 1st Additional District Judge at Howrah to take up the hearing of the Title Appeal No. 113 of 2012 on the next date fixed i.e., on 13th November, 2025 and make all endavours to dispose of the appeal as expeditiously as possible but preferably within a period of six months from the next date fixed without granting unnecessary adjournments to either of the parties.

This order has been passed taking note of the fact that the appeal is pending from 2012.
