... petitioners Mr. Himangshu De, Mr. Navanil De, ... for the petitioners Mr. Swapan Banerjee, Ms. Purnima Ghosh, .... for the State Mr. Himangshu De, learned senior advocate appearing for the petitioners submits that the petitioners are in custody for about 40 days.

He further submits that the main allegation levelled against the petitioners under Section 21 of the Mines and Minerals Act, 1957, is a compoundable offence.

Having regard to the period of detention already undergone by the petitioners and having regard to the complicity of the petitioners, as apparent from the case diary, I am of the opinion that the further custodial interrogation of the petitioners is not necessary in this case. Accordingly, the prayer for bail is allowed. The petitioners, namely, Sukumar Dolai, Sanyashi Dolai and Ajit Dolai, shall be released on bail upon furnishing a bond

of Rs. 5,000/- (Rupees Five Thousand Only) each, with two sureties of like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, Ghatal, with further conditions that the petitioners shall meet the investigating officer of the case once in a fortnight and shall not leave the jurisdiction of the local police Station without the permission from the Officerin-Charge of the said police station. The application for bail being CRM 6189 of 2021 is, thus, disposed of.
