Learned counsel for the petitioner submits that the petitioner has applied for new electricity service connection to his premises, which is a separately mutated one. However, the CESC Limited has refused to give such connection on the ground that service connection already exists in the premises, which is disputed by the petitioner.

Learned counsel appearing for the CESC Limited contends that the CESC Limited, upon holding an inspection on June 14, 2022, as admitted by the petitioner in paragraph- 6 of the writ petition, came to know that there is an existing electricity supply to the self-same premises, which caters to at least four electricity

meters. Although the petitioner has apparently built a new meter room, a separate service connection cannot be given at the premises, in view of the existence of the previous supply. However, learned counsel for the CESC Limited, in his usual fairness, submits that the CESC Limited has no objection to take steps for giving a new metered connection from the existing service connection, if the petitioner applies for a new electricity meter from the existing meter board location, upon compliance of all due formalities and subject to feasibility in that regard.

Hence, WPA No. 14385 of 2022 is disposed of by granting the petitioner liberty to apply for a separate metered electricity connection at his portion of the premises from the existing meter board position.

If so applied, upon compliance of all due formalities by the petitioner and subject to feasibility in that regard, the CESC Limited shall expeditiously give such connection to the petitioner, preferably within a week from compliance of all due formalities.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
