1. Heard learned Counsel for the parties.

2. The petitioner is stated to have absconded for six years and proclamation has been executed in the meantime. Trial having already been split up against the petitioner has already commenced.

3. In view of such conduct of the petitioner, we are not inclined to exercise our discretion in favour of the petitioner under Section 438 Cr.P.C.

4. Accordingly, the prayer for anticipatory bail is rejected.
