This revisional application was preferred challenging the maintenance awarded by the learned Additional Chief Judicial Magistrate, Contai, Purba Medinipur. The quantum so awarded was Rs.5,000/- per month in the proceeding under Section 125 of the Code of Criminal Procedure. I have taken into account the reasons so assigned by the learned Magistrate in the evidence particularly, with regard to the examination-in-chief of PW-1 and the crossexamination which was conducted on behalf of the husband/petitioner herein. Considering the reasons which have been assigned by the learned Additional Chief Judicial Magistrate, Contai, Purba Medinipur in Misc. Case No. 158 of 2016, I am of the view that the same do not call for any interference by this Court. However, if there are change of circumstances, the petitioners would take out appropriate application for alteration of maintenance before the learned Additional Chief Judicial Magistrate, Contai, Purba Medinipur by adducing appropriate evidence.
With the aforesaid observations, the revisional application being CRR 2196 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.
