1. The writ application has been preferred praying for direction upon the Central Government Industrial Tribunal which disposed of Reference 1 of 2015 on 16th February, 2024 finally, to dispose of the application under Section 33A of the Industrial Disputes Act being Misc. Case No. 02 of 2015 in accordance with law.

2. It is stated that the learned Tribunal completely overlooked the Misc. Case which was filed on 3.9.2015 and was also pending adjudication by the tribunal.

3. The Tribunal decided the reference in full but admittedly did not dispose of the Misc. Case while disposing of the said reference.

Accordingly, the writ application is disposed of with the direction that the Central Government Industrial Tribunal, Kolkata shall decide the Misc.

Case No. 02 of 2015 filed in Reference 1 of 2015, in accordance with law, on giving an opportunity of hearing to the respective parties in this case.

5. Accordingly, WPA 15306 of 2024 disposed of.

6. All parties to act on the server copy of this order.
