Criminal Revisional Jurisdiction (Via video-conference) C.R.R 2067 of 2018 In Re: An application under Section 482 of the Code of Criminal Procedure.

In the matter of : Sri Sumanta Kumar Ghosh ...Petitioner. The present application has been preferred challenging the judgement and order dated 30th April, 2018 passed by the learned Additional Sessions Judge, FTC - IV, Barrackpore, North 24 Parganas in Criminal Revision No. 90 of 2017.

The subject matter of the revisional application related to the interim maintenance which was allowed by the learned Judicial Magistrate, 2nd court, Barrackpore, North 24 Parganas by its order dated 13.02.2017 wherein the learned Magistrate was pleased to award Rs.3000/- per month to the wife and Rs.5000/- per month to the minor son from the date of the order.

On perusal of the order passed by the learned revisional court, it appears that the revisional court has scanned the materials which were available before the learned Magistrate and on an appreciation of the same, dismissed the revisional application and affirmed the judgment and order passed by the learned Magistrate. Having regard to the quantum awarded as maintenance for the wife and the minor son which was by way of an interim measure

during the pendency of the main revisional application, I am of the opinion that neither the order of the learned Magistrate nor that of the revisional court calls for any interference.

Accordingly, the revisional application being CRR 2067 of 2020 is dismissed.

All pending applications, if any, in connection with the revisional application, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
