21.08.2025 KAUSHIK Rejected C.R.M. (NDPS) 781 of 2025 In Re:- An application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Ranitala Police Station case no. 970 of 2024 dated 25.11.2024 under Sections 21(c)/29 of the NDPS Act 1985.

Petitioner Ms. Shabana Hasin ...for the Petitioner Ms. Baishali Basu Ms. Diksha Ghosh ...for the State Leaned counsel for the petitioner submits that the petitioner is in custody for about 269 days and that though charge-sheet has been submitted in this case but charge has not yet been framed and as such there is uncertainty as to when the trial would commence and for which considering the period of incarceration suffered by the present petitioner, he may be released on bail on any terms and conditions. Learned counsel for the State opposed the bail prayer contending that the commercial quantity of contraband was recovered from the exclusive possession of the present petitioner and that investigation has already been culminated in a charge-sheet and the next date is fixed on 29th August, 2025 for framing of charge.

Having considered the submissions made on behalf of both the parties and the materials placed before me, it

appears that the petitioner has failed to overcome the restrictions imposed under Section 37 of the NDPS Act and as such the prayer for bail made by the petitioner is rejected. Accordingly, CRM (NDPS) 781 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
