Biswajit Mahato v. State Of West Bengal
24.2.2022 sb CRR 2070 of 2018 (Via video conference) In Re: An application under Section 482 of the Code of Criminal Procedure, 1973.
In the matter of : Biswajit Mahato .......Petitioner Mr. Mrityunjoy Chatterjee Mr. Kaushik Dey .......for the Petitioner Mr. S.G.Mukherjee, Ld. PP Mr. Arijit Ganguly Ms. Sujata Das ...for the State Mr. Chatterjee, learned advocate appearing for the petitioner submits that the petitioner approached this court in the year 2018.
As none appears on behalf of the State, Mr. Ganguly, learned advocate who ordinarily appears on behalf of the State, is directed to appear in this matter. His appointment may be regularised by the concerned authorities.
Having regard to the change of circumstances because of the pendency of the revisional application for a considerable period of time, I am of the opinion that one of the prayers so advanced before this court, by this time, has become infructuous. However, having regard to the fact that the petitioner, at the relevant point of time, was in custody, I direct that in case, the trial has not concluded, the learned trial Court would take efforts to conclude the trial within a reasonable period of time by fixing at least a schedule of three days on each and every month.
With the aforesaid observations, the revisional application being CRR 2070 of 2018 is disposed of.
Pending applications, if any, are consequently, disposed of. All parties are to act on the server copy of this order, duly obtained from the official website of this Court. (Tirthankar Ghosh, J.)
