Subham Kr Sadhu & ANR v. State Of West Bengal
10.03. 2022 item No.64 n.b.
ct. no. 34 CRR 2076 of 2018 Subham Kumar Sadhu & Anr.
Vs.
The State of West Bengal Mr. Madhusudan Sur, Mr. Dipankar Paramanick ... for the State.
The present revisional application has been preferred challenging the proceedings in connecting with the Sonarpur Police Station case No.873 of 2017 dated 13.5.2017 under Section 498A/307/406 of the Indian Penal Code.
Today the matter has been called, none appears on behalf of the petitioner.
Mr. Sur, learned advocate appears on behalf of the State and submits a report. Let the report be kept with the record. Report reflects that next date has been fixed on 18.6.2022 for framing of charges. The petitioner approached this court at a stage when the charge sheet was presented before the learned Magistrate and the learned Magistrate was pleased to take cognizance of offence. None of the documents under Section 207 of the Code of Criminal Procedure on which the prosecution relies to prove its case have been relied upon and/or enclosed along with the revisional application for consideration of this Court. In view of such materials not being presented before this court, I am of the opinion, that the stage at which the petitioner approached this
court is a prematured stage, and as such do not call for interference.
Accordingly, CRR 2076 of 2018 is dismissed.
All pending connected applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
