The petitioner complains that the police are not taking any steps in response to the complaint filed by him.

Learned advocate representing the State respondents submits, upon instruction that, on receipt of the complaint an enquiry was conducted and it was found that two storied building has already been erected in the subject plot of land. The petitioner was requested to submit relevant documents in support of his ownership but he failed to do so. There are many co-sharers to the land in question.

The allegation of the petitioner of being threatened by the private respondents showing fire arms could not be substantiated.

The police have diarized the complaint submitted by the petitioner being Kashipur PS GDE No. 1524 dated 26th October, 2023.

It appears from the submission made on behalf of the parties that there are several disputed question of facts with regard to ownership and possession of the subject property. Police are not the competent authority to decide the aforesaid issues. In view of the above, it will be open for the petitioner to approach the competent Civil Court for protection of his civil rights.

Police shall, however, maintain strict vigil and ensure that there is no breach of peace at the locale. The writ petition stands disposed of.
