Let the affidavit of service filed by the petitioner be kept with the records.

Petitioner's father died in harness on April 6, 2021, while holding the post of Laboratory Attendant in Bangabasi Evening College, Kolkata.

The said college by a letter dated October 29, 2021, forwarded all documents to the Director of Public Instructions, West Bengal proposing the name of the petitioner to be appointed in died in harness category.

The case of the petitioner till date, however, has not been considered by the Director of Public Instructions, West Bengal.

In view of the above factual matrix, this writ petition is disposed of with a direction upon the Director of Public Instructions, West Bengal to take a decision with regard to the appointment of the petitioner in died in harness category within a period of two months from the date of communication of this

order. In arriving such a decision, the Director of Public Instructions shall hear the petitioner as well as the college authority. The decision should be communicated to the petitioner within one week thereafter.

With the aforesaid observations, WPA 14393 of 2022 is disposed of.

Let urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
