Affidavit-of-service filed in Court today is taken on record.

The petitioner is the heir of a deceased primary school teacher. He is physically handicapped. He seeks benefit in terms of the memorandum being No. 325SE(B)/1M-43/2003 dated 5th September, 2005. A representation has been made by the petitioner before the respondent authorities in April 2024. The same is yet to be considered by the respondent authorities.

Without entering into the merits of the claim of the petitioner, the instant writ petition is disposed of by directing the respondent no.2, Commissioner of School Education to consider the prayer of the petitioner in accordance with the aforesaid memorandum and if it is found that the petitioner satisfies the conditions as mentioned in the said memorandum, then consequential relief shall be granted in his favour at the earliest.

The aforesaid respondent shall take a decision in the matter positively within a period of eight weeks. A

reasoned order shall be passed and communicated to the petitioner immediately thereafter.

Learned advocate appearing for the petitioner is directed to forward a copy of the representation dated 29th April, 2024 along with all documents in support of his claim to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.
