Mr. Prabir Adhya Ms. Madhumita Chakraborty ..for the petitioners The respondent nos. 2, 3 and 4 in Miscellaneous Appeal No. 29 of 2024 have approached this Court praying for a direction upon the learned Additional District Judge, Fast Track Court No. III, Krishnagar, Nadia to dispose of the said miscellaneous appeal expeditiously.

The learned advocate appearing for the petitioners submits that the miscellaneous appeal arises out of an order of injunction passed under Order 39 Rule 1 and 2 of the Code of Civil Procedure in the Title Suit No. 253 of 2024.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioners shall be obliged to forward a copy of this application along with a server copy of this order upon the opposite parties.

After going through the order sheets appended to this application this Court finds that 31st August, 2026 has been fixed for hearing of the said appeal.

In the light of the submissions made by the learned advocate for the petitioners, C.O. 2071 of 2026 stands disposed of by requesting the learned Additional District Judge, Fast Track Court No. III, Krishnagar, Nadia to take up the hearing of the appeal on the next date fixed i.e. on 31st August, 2026, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
