For the State The petitioner is aggrieved with the fact that pursuant to the representation which was made to the Officer-in-Charge, Nabadwip Police Station the case being Nabadwip Police Station case no. 54 of 2024 dated 24th January, was registered for investigation. However, the said investigation was not taken to its logical conclusion till date. The petitioner prayed for arrest of the accused persons. However, it is the prerogative of the investigating officer to assess regarding circumstances whether the custodial interrogation of an individual is required. The Court of law cannot enter into the said domain.

Having considered that the case was registered on or about 24th January, 2024 and more than one year has passed, I am of the view that if the petitioner has any grievance relating to investigation, the petitioner shall bring it to the notice of the learned jurisdictional Magistrate, who shall in accordance with law pass necessary directions as he deems fit and proper.

As none appears for the State, Sk. Md. Masud, learned advocate, who ordinarily appears on behalf of the State, is requested to appear for the State in this matter. His appointment will be regularised by the concerned authority.

In view of the directions passed above, the writ petition being W.P.A. 15282 of 2024 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
