Learned advocate for the petitioner submits that the petitioner is in custody for more than 1071 days. He submits that since police submitted charge sheet, further detention of the petitioner is not necessary.

Learned advocate for the State opposes the prayer for bail and draws attention of this Court to the statement recorded under section 164 Cr.P.C., the medical report and the age of the victim girl.

Considering the materials in the case diary and considering the age of the victim i.e. 13 years and the statement recorded under section 164 Cr.P.C, we are not inclined to grant bail to the petitioner.
