The petitioner seeks parity with the co-accused who have granted bail by this Court earlier.

Opposing the prayer, learned counsel for the State submits that the State sought cancellation of bail granted to one of the coaccused by the trial Court. By an order passed on 25th March, 2025 this Court dismissed the application with an observation that since the FSL report which supports the prosecution case was not with the learned jurisdictional Court when bail was granted, the order was not vitiated by perversity. The petitioner appears to be similarly circumstanced with the co-accused who have been granted bail earlier and deserves the same benefit.

Accordingly, the prayer for bail is allowed.

The petitioner namely Md. Shafik @ Raja be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local,

to the satisfaction of the learned Chief Judicial Magistrate, Purulia subject to the condition that he shall appear before the learned trial Court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. In the event the petitioner fails to appear before the learned trial Court on any date without any justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.

The application for bail is disposed of.
