Report submitted by the learned advocate appearing for the State be also kept with the record. A copy of the report be handed over to the learned advocates appearing for the petitioner and the private respondents.

The petitioner and the private respondents are at loggerhead over the issue relating to construction while the learned advocate appearing for the petitioner submits that there is a sanctioned plan and the construction of the properties are on her own land.

On the other hand, learned advocate appearing for the private respondents submits that the property of the petitioner has been encroached, as such the sanctioned plan has been challenged and appropriate measure has been taken by the private respondents.

State has submitted a report which reflects that police authorities are aware regarding the

inimical relationship existing between the petitioner and the private respondents and as such, drawn up proceedings under Sections 126/135(3) of BNSS. In view of the nature of the dispute, it would be the appropriate forum who would decide regarding construction as well as the legality and illegality of the ownership of the land. The police authorities would only ensure that there is no violation and/or breach of law and order because of the strained relationship existing between the parties.

With the aforesaid observations, the writ petition being WPA 14297 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
