The petitioner alleges that despite complaints having been lodged before the Inspector-in-Charge, Katwa Police Station against the respondent nos. 5 & 6, no steps have been taken by the police authorities. It is alleged that the said respondents entered into an agreement for sale of vested land with the petitioner. Considerable amount of money had been taken from the petitioner.

Reference is made to letters written by the Block Land & Land Reforms Officer with regard to such unlawful activity.

Learned advocate for the respondent nos. 5 & 6 denies such allegations. It is submitted that the

order of vesting had been set aside by the High Court. The proceedings therefrom, are pending before the Hon'ble Apex Court. It is also submitted by the learned advocate for the respondent nos. 5 & 6 that unless the order of vesting becomes final, upon reversal of the order of the High Court, the allegations made by the petitioner against the respondent Nos.5 and 6, could not be accepted. The police authorities have filed a report. The same be kept on the record.

It appears that Katwa Police Station Case No. 600/22 dated August 27, 2022, under Sections 420/406/506/34 of the Indian Penal Code was started against the FIR named accused persons. The investigation is in progress.

Under such circumstances, nothing remains to be decided in the writ petition.

The disposal of the writ petition shall not be construed as an observation of the court on the merits of the allegations. It is entirely within the domain of the investigating agency to unearth the truth.

The writ petition is accordingly disposed of. There shall be no order as to costs.
