A copy of the discharge document as handed over by the learned counsel for the respondent no.6/husband is also taken on record.

Report filed on behalf of the State is also taken on record.

From the report it appears that the Medical Board did not think it necessary that the petitioner should undergo treatment while remaining admitted in a hospital. They are of the view that the patient is in a stable condition and should be discharged. Follow up treatment may continue for some time.

Learned counsel for the State relies on the report and

submits as follows. Upon instructions, it is submitted that at the time of discharge of the patient from the Institute of Psychiatry, police personnel were present along with the husband of the patient and the present petitioner. The patient voluntarily decided to go with the husband and stay with him.

Accordingly, the patient is now staying with the husband/ the respondent no.6.

The patient shall be at liberty to ask the petitioner to hand over the key of a flat and other property related documents, if any.

No further order need be passed in this regard. Accordingly, the writ petition is disposed of. Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
