The matter is taken up for hearing when RCC Institute of Information and Technology (hereinafter referred to as the "said College"), State respondents, State Information Commission and Directorate of Technical Education, West Bengal, are represented by the learned advocates. Writ petitioner is not represented today.
The writ petition relates to supply of information as sought for by the petitioner from the said college. The matter was heard on several dates in presence of the learned advocates representing the petitioner and the said college as well as State
Information Commission. At that point the State respondents as well as Directorate of Technical Education, West Bengal, were not represented before this Court. On hearing this petition on number of occasions ultimately this Court found that there was a writing dated 16th May, 2022 of the petitioner indicating the information and copies of documents supply of which petitioner was seeking. This Court had the occasion to consider the said writing dated 16th May, 2022 which was taken on record.
After hearing learned advocates representing the parties including the petitioner and considering the queries made in the said writing dated 16th May, 2022 an order was passed on 22nd June, 2022 directing the petitioner to attend the Office of the Registrar of the said college on 24th June, 2022 at 12 noon for inspection of relevant documents and supply of information in connection with query nos. 3 and 5(c) as contained in the said writing dated 16th May, 2022 of the petitioner. Regarding query no. 4 of the petitioner as indicated in the writing dated 16th May, 2022 this Court on 22nd June, 2022 made a direction to the Registrar of the said college to supply the copy of the report of 3-Member Enquiry Committee if the
same is available on record.
Today, Mr. Chaturvedi, learned advocate, representing the said college has submitted that the information and the copies of the documents against query no. 3 subject to availability of the same on the records of the said college authorities as well as against query no. 5 (c) have been provided to the petitioner. However, it has been submitted that so far query no. 4 of the writing dated 16th May, 2022 of the petitioner is concerned there was no 3-Member Enquiry Committee in connection with the petitioner and there was no indication in the said writing dated 16th May, 2022 that which 3-Member Enquiry Committee report and copy thereof was sought for. As a result thereof, it has been submitted on behalf of the said college authority that the information against query no. 4 could not be provided to the petitioner. Query nos.
1 and 2 of the writing dated 16th May, 2022 were required to be considered by the Directorate of Technical Education, West Bengal as well as concerned authority of Higher Education Department, Government of West Bengal.
filed before this Court one by Mr. Raja Saha, learned senior Government advocate, representing State respondents and another by Mr. Amitava Chaudhuri, learned advocate, representing Directorate of Technical Education, West Bengal. The content of those two reports are common which goes to show that the request made by the petitioner in connection with query nos. 1 and 2 of the writing dated 16th May, 2022 have been replied by supplying copy of acceptance of resignation of Professor Sajal Dasgupta vide memo dated 30th June, 2011 issued by the Joint Secretary to the Government of West Bengal, Higher Education Department and copy of the proposal dated 10th June, 2008 being No. rcciit/pri/admin/08-09/05. In view of aforesaid developments on responding to the queries of the petitioner as per writing dated 16th May, 2022 and considering previous order passed by this Court on 22nd June, 2022 it appears no other issues as raised in this writ petition are required to be decided.
Accordingly, writ petition stands disposed of. However, there shall be no order as to costs.
The reports filed on behalf of Directorate of Technical Education, West Bengal, as
well as the State respondents are taken on record. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
