The petitioners apprehend that the private respondents are trying to forcefully evict them from the property.

The petitioners claim to be in lawful possession in terms of an agreement for sale. The petitioners have already approached before the Consumer Forum against the seller and have sought registration of the property.

This Court directs that appropriate proceedings under Sections 107 and 116(c) shall be taken by Baranagar Police Station against the private respondents.

It shall be ensured that there is absolutely no breach of peace in the area. Any other civil rights than those before the Consumer Forum may be agitated by the petitioners before an appropriate Civil Court. With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
