The restoration applications have been filed in connection with the appeals, being FMA 1307 of 2015, FMA 1308 of 2015, FMA 1309 of 2015, FMA 1310 of 2015 and FMA 1314 of 2015.
Having heard the learned advocates appearing for the respective parties and upon perusal of the averments made in the applications justifying the absence of the learned advocate-on-record of the appellant(s) in court on 20th March, 2025, we are satisfied with such justification. Accordingly, the restoration applications in connection with the appeals, being FMA 1307 of 2015, FMA 1308 of 2015, FMA 1309 of 2015, FMA 1310 of 2015 and FMA 1314 of 2015, are allowed.
The order dated 20th March, 2025 is recalled and the appeals, being FMA 1307 of 2015, FMA 1308 of 2015, FMA 1309 of 2015, FMA 1310 of 2015 and FMA 1314 of 2015 and the connected applications, if any, filed in connection thereto are restored to their respective files and numbers. It has been pointed out that no application for restoration of the appeals, being FMA 1311 of 2015, FMA 1312 of 2015, FMA 1313 of 2015, FMA 1315 of 2015 and
FMA 2024 of 2024 has been filed though they were also dismissed by a common order.
In view thereof, let the appeals, being FMA 1311 of 2015, FMA 1312 of 2015, FMA 1313 of 2015, FMA 1315 of 2015 and FMA 2024 of 2024 be detagged from the appeals which are restored to their respective number and files. Mr. Biswas submits that in terms of an earlier direction of this Court, paper book has already been filed and copy of such paper book has already been served upon the learned advocates appearing for the respondents. He further submits that the appeals are otherwise ready for hearing.
In view thereof, list the matters for further consideration in the combined monthly list of January, 2026.
Interim order passed earlier in respect of the appeals, being FMA 1307 of 2015, FMA 1308 of 2015, FMA 1309 of 2015, FMA 1310 of 2015 and FMA 1314 of 2015 is reinstated.
