The order of demolition passed by the Special Officer (Building) dated 21st February, 2023 is under challenge in the present writ petition.

Learned advocate appearing for the petitioner submits that the said order being an appealable one a statutory appeal has been filed. The same is numbered as B.T. Appeal No.106 of 2023.

As the statutory appeal is pending consideration, there is no requirement of proceeding with the writ petition any further.

It will be open for the petitioner to proceed with the statutory appeal before the Kolkata Municipal Corporation Building Tribunal.

The writ petition stands disposed of.
