( Via Video Conference ) Mr. Arif Ali ... for the petitioner The grievance of the petitioner is that the application under Section 151 of the Code of Civil Procedure filed by the petitioner on February 12,2020 in connection with Title Suit No. 8188 of 2012 pending before the learned Civil Judge (Senior Division ), 10th Court at Alipore was taken up for hearing on December 22,2020 and the same was adjourned thereafter on several occasions on frivolous grounds.

It has been further submitted by the learned advocate for the petitioner that the next date fixed for hearing of the said application is on October 8,2021. 2021.

In view of the order sought and proposed to be passed there is no necessity of issuing notice upon the opposite party. However, the petitioner shall be obliged to forward a copy of this application as well as this order upon the opposite parties or their learned advocates in the Court below.

Co 1678 of 2021 is disposed of by requesting the learned Civil Judge (Senior Division ), 10th Court at Alipore to take up the hearing of the said petition dated February 12,2020 filed under Section 151 of the Code of Civil Procedure praying for discharging the defendant no. 1 as a joint receiver on the next date fixed i.e. on October 8,2021 and to dispose of the same

as expeditiously as possible and preferably within a period of three months from the next date fixed without granting any unnecessary adjournment to either of the parties.
