The parties are relatives of each other. Out of family dispute, on the basis of a complaint submitted by the opposite party CR Case No. 1142/2019 under Sections 323/384/379/506/504 of the Indian Penal Code was registered. The said case is pending before the learned Judicial Magistrate, 2nd Court at Burdwan. Presently, the parties have filed a joint petition for compromise stating, inter alia, that the dispute between them has been amicably settled out of Court. Therefore, the complainant does not want to proceed with the instant criminal case against the present petitioner.
In view of such circumstances, the compromise is accepted and CR Case No. 1142/2019 is quashed. The learned Judicial Magistrate, 2nd Court at Burdwan is directed to pass a formal order of discharge or acquittal of the petitioner as the case may be in view of amicable settlement of the dispute. The instant revision along with connected application is accordingly disposed of.
