Ranajit Nandi v. State Of West Bengal & ANR
CRR 1851 of 2015 Ranajit Nandi Vs.
State of West Bengal & Anr.
None appears on behalf of either of the parties. This matter is 16.12.2022 Court No.35 Item No. 19 I.T (p.a) pending in the list since 15.11.2022 and has been called on each day of working of this court since that date. Inspite of that no one is appearing. The petitioner is found to be not interest in this case. Therefore, the same is taken up today for disposal on merit. Petitioner has challenged the judgment and order dated 23.04.2014 passed by the Ld. Sessions Judge, Bankura in connection with Criminal Revision No.62 of 2013. The order of the Ld. Judicial Magistrate, 3rd Court at Bishnupur dated 21.04.2013 was assailed therein.
The matter relates to a proceeding under Section 125 Cr.P.C, 1973, and by dint of the impugned order the Sessions Judge has modified the order of the Magistrate to the tune that the wife, i.e, opposite party no.2 shall receive an amount of Rs. 3000/- per month for herself and Rs. 1000/- per month for the minor as maintenance. The same is challenged in the instant revision.
On perusal of the entire materials available on record and the grounds made up by the petitioner I am constrained to find that the grounds thereof are not sufficient and cogent enough to warrant this court's interference into the impugned order. Hence, in my considered opinion the revision is liable to be dismissed. Criminal Revision being CRR 1851 of 2015 is dismissed. Certified website copies of this order, if applied for, be supplied to the parties subject to compliance with all the requisite formalities. (Rai Chattopadhyay, J.)
